1. INTRODUCTION AND ACCEPTANCE

1.1. These Terms of Service constitute a legally binding agreement between you (the patient, client, or website user) and Assessments and Answers Psychology Pty Ltd ACN 671 096 736 ABN 37 671 096 736 (Assessments and Answers Psychology), a company registered in Queensland and operating psychological assessment services across Australia. By accessing our website at https://assessmentsandanswerspsychology.com/ (Website), booking appointments through our online patient portal, or receiving psychological assessment services from our practice, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety.

1.2. Assessments and Answers Psychology operates as a specialist practice providing psychological assessment services for children between the ages of 2-16 suspected of having neurodivergence and/or cognitive/academic limitations. Our practice focuses on delivering personalised assessments through mobile services in home and school environments, as well as in clinic rooms.

1.3. These Terms of Service govern all aspects of our relationship with you, including but not limited to the provision of psychological assessments, online appointment booking through our patient portal, payment processing for services, communication through digital platforms and secure messaging systems, and access to our patient support services. The terms apply regardless of whether services are provided in-person, via telehealth platforms, through our patient portal, or through any future service delivery methods we may implement.

1.4. By continuing to use our services, you confirm that you are legally capable of entering into binding agreements and that you have the authority to accept these terms on behalf of any person for whom you may be seeking medical services. If you are accepting these terms as a legal guardian, carer, or under an Enduring Power of Attorney, you warrant that you have the necessary legal authority to do so and that such acceptance is in the best interests of the person receiving medical care. For patients under 18 years of age, a parent or legal guardian must provide consent and accept these terms on behalf of the minor patient.

1.5. We reserve the right to modify these Terms of Service at any time to reflect changes in our service offerings, regulatory requirements, technology platforms, or business operations. Any modifications will be posted on our website at https://assessmentsandanswerspsychology.com/ with an updated effective date, and your continued use of our services following such modifications constitutes acceptance of the revised terms. We encourage you to review these terms periodically to ensure you remain informed of any changes that may affect your rights and obligations as our client.

2. PROFESSIONAL STANDARDS AND SERVICE DELIVERY

2.1 Our psychologists are registered with the Australian Health Practitioner Regulation Agency (AHPRA) and provide clinical assessments and prepare recommendations based solely on clinical findings, professional judgement, and evidence-based practice principles. We maintain professional independence in all clinical decision-making and do not guarantee specific outcomes or assessment results.

2.2. We do not provide emergency medical services and are not a substitute for emergency care. If you are experiencing a medical emergency, you must call 000 immediately or present to your nearest emergency department. Our services are designed for non-emergency psychological assessments.

2.3. Our practice specialises in psychological assessments, recognising that this mode of service delivery has limitations and may not be appropriate for all clinical situations. We continuously assess the appropriateness of our services for each client and may recommend consultation with other healthcare providers when clinically necessary.

3. SERVICES AND APPOINTMENTS

3.1. We provide psychological assessment services for children between the ages of 2-16. This may include assessments for autism, attention deficit and hyperactivity disorder, cognitive impairment, and/or specific learning disorder (e.g., dyslexia). We do not provide intervention services.

3.2. Our appointment booking system operates through our online client portal, phone, and email. 

3.3. Our cancellation and rescheduling policy requires specific notice periods to avoid cancellation fees:

3.3.1. More than 7 business days’ notice: Full refund (excluding deposit)
3.3.2. 48 hours to 7 business days’ notice: 25% cancellation fee
3.3.3. 24 to 48 hours’ notice: 50% cancellation fee
3.3.4. Less than 24 hours’ notice or no-show: Full fee applies
3.3.5. Exceptional circumstances: Fees may be waived at the discretion of the clinic

4. TELEHEALTH SERVICES

4.1. Our telehealth consultations comply with Australian healthcare guidelines and utilise secure, encrypted platforms that meet the standards of privacy protection and clinical safety. Our primary telehealth platforms are Zoom (via Zanda) and Microsoft Teams. Patients must ensure appropriate technology including a reliable internet connection, compatible device with camera and microphone capabilities, and a private consultation environment that protects confidentiality and enables effective clinical communication.

4.2. Before telehealth consultations, we verify patient identity, explain the consultation process and any limitations of telehealth delivery, confirm billing arrangements and payment processing, and ensure patient consent for telehealth service delivery. We continuously assess the appropriateness of telehealth delivery throughout each consultation and may recommend in-person consultation with other healthcare providers if clinically necessary for safe and effective care.

4.3. All telehealth consultations maintain the same documentation standards, clinical assessment protocols, and professional requirements as in-person consultations.

5. PAYMENT TERMS

5.1. All consultation fees are payable in full immediately following each appointment, unless otherwise agreed in writing. We reserve the right to cancel, suspend, or refuse future appointments or services in circumstances where payment has not been received in accordance with these Terms.

5.2. We accept:

5.1.3. Cash

5.3. Payment processing is conducted through encrypted, secure channels via Xero and Stripe.

5.4. A 1.7% surcharge applies to payments made by credit or debit card to cover reasonable transaction processing costs. This surcharge will be automatically added to the total amount payable at the time of payment. Alternative payment methods, such as direct bank transfer or cash, do not attract this surcharge.

5.5. Our services are provided on a private basis. A referral from a paediatrician or psychiatrist is required for Medicare rebates on certain assessments. We do not offer bulk billing.

5.6. For patients experiencing financial hardship or billing concerns, we encourage you to contact our administrative team at admin@assessmentsandanswerspsychology.com.au to discuss your circumstances. Payment plans may be available via direct debit agreement.

5.7. We provide itemised invoices for all services through our practice management system, with invoices delivered electronically unless alternative arrangements are specifically requested. All billing practices comply fully with Australian Consumer Law provisions regarding transparent pricing, fair dealing, and consumer protection requirements.

5.8. Assessment fees are based on clinical time, the use of assessment materials, interpretation and analysis of results, preparation of a comprehensive report, and the provision of personalised recommendations.

5.8.1. Autism Assessment Fee: $2,620
5.8.2. ADHD Assessment Fee: $2,370
5.8.3. Combined Autism and ADHD Assessment Fee: $3,870
5.8.4. Cognitive and Learning Assessment Fee: $2,870 

5.9. Additional fees may apply where extra services are required, including but not limited to extended sessions, travel outside the usual service area, additional reporting or liaison with third parties, or expedited report delivery.

6. MEDICARE REBATES

6.1. Where a valid referral has been issued by a paediatrician or psychiatrist and provided to the Service, the client may be eligible to claim applicable Medicare rebates for certain eligible services. Medicare rebates may be processed by the Practice on behalf of the client at the time of payment, or alternatively, the client may independently submit a claim to Medicare through myGov or other approved Medicare claiming pathways. Eligibility for rebates, rebate amounts, and processing timeframes are determined solely by Medicare Australia
and are subject to change.

6.2. Medicare rebates do not cover the full cost of services. The client remains responsible for payment of the full session fee to the Practice at the time of service, regardless of any subsequent rebate entitlement or processing outcome through Medicare.

6.3. The Practice will take reasonable steps to assist with rebate processing when requested; however, it accepts no liability for any delay, error, or rejection of Medicare claims. Responsibility for verifying eligibility, maintaining valid referral documentation, and resolving rebate issues rests solely with the client.

7. PRIVATE HEALTH INSURANCE

7.1. Where applicable, clients with eligible Private Health Insurance policies may be entitled to rebates for psychological services in accordance with the terms of their insurer. The availability and amount of any rebate are determined solely by the Insurer and may vary depending on the policy type, service provided, and provider registration.

7.2. The Practice may, where systems permit, process private health insurance claims at the time of payment. Alternatively, the client may submit a claim directly to their Insurer following payment. The Practice accepts no responsibility for the outcome of rebate claims, policy eligibility, or any delays or errors in processing by the Insurer.

8. PRIVACY AND CONFIDENTIALITY

8.1. Where a client is eligible for funding under the National Disability Insurance Scheme (NDIS), fees for services may be covered in part or in full under their approved plan, subject to the terms, funding category, and budget allocated by the National Disability Insurance Agency (NDIA). The client or their nominated plan manager may submit claims for reimbursement to the NDIA or relevant plan manager.

8.2. NDIS funding may not cover the full cost of services. The client remains responsible for payment of any portion of fees not covered by their NDIS plan at the time of service, including any additional costs associated with extended sessions, travel outside the usual service area, or extra reporting or liaison.

8.3. The Practice will take reasonable steps to assist with NDIS claim processing when requested; however, it accepts no liability for any delay, rejection, or dispute of claims with the NDIA or plan manager. Responsibility for verifying funding eligibility, maintaining plan approvals, and
resolving payment issues rests solely with the client or their nominated plan manager.

9. PRIVACY AND CONFIDENTIALITY

9.1. We comply with the Privacy Act and Australian Privacy Principles, with protections for sensitive health information reflecting the nature of our psychological assessment services. We collect, use, and disclose personal and health information only for clinical care delivery, administrative purposes, and professional obligations as outlined in our Privacy Policy.

10. CONSENT MANAGEMENT

10.1. We obtain informed consent for all clinical services, information sharing with healthcare providers, and communication through our digital platforms. Our consent processes are designed to ensure you understand the nature of our services, any limitations of our service delivery, information sharing arrangements, and your rights regarding your personal and health information.

10.2. We utilise digital consent processes through our secure patient portal and practice management systems, with documentation in clinical records of all consent decisions and modifications. During your initial registration, you will be required to acknowledge and consent to our administrative team having access to your personal information strictly for administrative purposes, ensuring transparency about our staffing arrangements and information access protocols.

10.3. We obtain specific informed consent for AI-assisted healthcare services (such as BastionGPT) before processing your personal and health information through this system. This consent includes understanding how the AI system assists in your care, the security measures in place, and your rights regarding AI processing of your information. You may decline AI- assisted services or withdraw consent at any time while continuing to receive our standard psychological assessment services. We maintain comprehensive documentation of all AI-related consent decisions and modifications.

10.4. Consent may be withdrawn at any time by contacting us at admin@assessmentsandanswerspsychology.com.au and we maintain detailed records of all consent decisions, modifications, and withdrawals. However, withdrawal of certain consents may impact our ability to provide specific services, particularly those requiring information sharing for safe and effective service delivery.

11. TECHNOLOGY PLATFORMS AND AUTOMATED SYSTEMS

11.1 We utilise technology platforms to deliver our services, manage patient information, and coordinate care delivery. Our primary systems include:

11.1.1. BastionGPT for AI-assisted clinical documentation and information processing
11.1.2. Zanda for practice management
11.1.3. Zoom and Microsoft Teams for telehealth consultations
11.1.4. NovoPsych for online assessments
11.1.5. Multi-Health Systems (MHS) for assessment tools
11.1.6. Western Psychological Services (WPS) for educational assessments
11.1.7. Pearson Clinical Assessments (Q-Global & Q-Interactive) for cognitive assessments

11.2. We do not utilise automated systems for clinical decision making, diagnosis formulation, or treatment recommendations. All clinical decisions remain under direct practitioner control using professional judgement, evidence-based practice principles, and clinical assessment protocols. Our technology platforms support clinical decision-making but do not replace professional psychological judgement.

11.3. We utilise AI service providers (such as BastionGPT), a secure AI-powered healthcare assistant, to enhance the quality and efficiency of our clinical documentation and information processing. BastionGPT operates exclusively under the control of our trained healthcare professionals and complies with all applicable healthcare data protection regulations. The AI system processes only the minimum necessary information required for your healthcare services and does not retain your data beyond the active session duration. All AI-assisted processing requires your informed consent, which may be withdrawn at any time without affecting your access to our core psychological assessment services.

12. PROFESSIONAL INDEMNITY AND LIABILITY

12.1. Our liability is limited to psychological services within our scope of practice and professional competence as registered psychologists. We maintain appropriate professional indemnity insurance coverage and operate within established professional guidelines for psychological service delivery and clinical practice standards.

12.2. We are not liable for outcomes beyond our direct control, including but not limited to:

12.2.1. Client compliance with recommendations
12.2.2. Interactions with other healthcare providers not coordinated through our practice
12.2.3. Technology failures affecting client devices or internet connectivity
12.2.4. Health outcomes influenced by factors outside our clinical assessment and recommendations

12.3. We do not guarantee specific outcomes or assessment results, as individual responses to psychological assessments vary significantly based on numerous factors.

12.4. Our telehealth liability is subject to the same professional standards as in-person consultations, with additional considerations for technology-related limitations and the inherent constraints of remote clinical assessment. We are not liable for clinical assessments that would require physical examination or diagnostic procedures not available through telehealth platforms, and we maintain clear protocols for recommending in-person consultation when clinically appropriate.

12.5. We are not liable for service delivery delays caused by factors beyond our reasonable control, including technology platform failures, internet infrastructure issues, payment processing delays, or other circumstances affecting our ability to provide timely services. We will make reasonable efforts to minimise delays and provide alternative arrangements where possible.

12.6. Our professional indemnity coverage and liability limitations are subject to Australian Consumer Law provisions that cannot be excluded by contract, including consumer guarantees for services rendered with due care and skill. Nothing in these terms excludes rights or remedies under Australian Consumer Law or other applicable legislation that cannot be lawfully excluded.

12.7. Our use of AI-assisted healthcare services through our AI service providers (such as BastionGPT) is subject to the same professional standards and liability frameworks as our other clinical services. We maintain professional oversight of all AI system interactions and ensure that AI assistance enhances rather than replaces professional clinical judgment. We are not liable for AI system performance issues beyond our reasonable control, including technology platform failures or service interruptions.

12.8. Clients with concerns about professional conduct, clinical care quality, or potential professional liability matters are encouraged to contact our practice directly at admin@assessmentsandanswerspsychology.com.au to discuss their concerns and seek resolution through our internal complaint handling processes.

13. COMPLAINTS AND DISPUTE RESOLUTION

13.1. We are committed to resolving complaints and disputes in a timely and respectful manner. Our internal complaint handling process includes acknowledgement of complaints, investigation of matters by appropriate personnel, and provision of written responses.

14. INTELLECTUAL PROPERTY

14.1. All content on our website, patient portal, and service delivery platforms, including text, images, graphics, logos, design elements, clinical protocols, and assessment materials, is owned by Assessments and Answers Psychology or our licensors and is protected by copyright and other intellectual property laws. Clients may access and use this content for personal healthcare purposes but may not reproduce, distribute, modify, or create derivative works without our express written permission.

14.2. Clinical reports and assessment results prepared by our psychologists remain our intellectual property while being provided to clients for intended healthcare purposes including ongoing care coordination, specialist referrals, and personal health management. Commercial use, unauthorised distribution, or reproduction of these materials is prohibited and may result in legal action.

15. THIRD-PARTY SERVICES

15.1. We utilise third-party platforms and service providers to deliver healthcare services, including:

15.1.1. AI healthcare assistance platforms (BastionGPT)
15.1.2. Payment processors (Xero, Stripe)
15.1.3. Practice management software (Zanda)
15.1.4. Telehealth platforms (Zoom, Microsoft Teams)
15.1.5. Online assessment platforms

15.2. While we select reputable third-party providers and maintain appropriate agreements regarding privacy protection and service delivery standards, we do not control their privacy policies, security measures, or business operations and are not responsible for their data protection practices, service delivery standards, or business decisions that may affect your experience.

16. FORCE MAJEURE

16.1. We are not responsible for service disruptions due to events beyond our reasonable control, including:

16.1.1. Natural disasters
16.1.2. Internet infrastructure failures
16.1.3. Technology platform outages
16.1.4. Government regulatory changes affecting healthcare delivery
16.1.5. Public health emergencies affecting service delivery capabilities
16.1.6. Other circumstances that prevent or significantly impair our ability to deliver services safely and effectively

17. GOVERNING LAW

17.1. These Terms of Service are governed by Australian law, specifically the laws of Queensland, where our practice is registered and operates. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

18. CHANGES TO TERMS

18.1. We may update these Terms of Service at any time to reflect changes in our service offerings, regulatory requirements, technology platforms, professional standards, or business operations. Changes will be posted on our website at https://assessmentsandanswerspsychology.com/ with an updated effective date, and clients will be notified of significant changes through our usual communication channels including email notifications and patient portal announcements.

19. GENERAL

19.1. These Terms of Service constitute the entire agreement between Assessments and Answers Psychology and clients regarding the provision of psychological assessment services. These terms supersede all prior agreements, understandings, representations, or communications, whether written or oral, relating to the subject matter covered by these terms.
